This agreement is made between Fire and Water, Inc. (Fire and Water) and the customer set forth
above "Customer,
" each of whom agree as follows:

Customer understands that mitigation services are intended to reduce and prevent additional
damage to the structure and/or contents. With respect to the structures on the Property, Fire and
Water will perform emergency cleaning and/or mitigation services. Fire and Water will perform
construction, reconstruction, or restoration work only if both the Customer and Fire and Water
complete and sign a Home Improvement Contract, which is a separate document.
Rebuild Estimate
At Customer's request, Fire and Water will prepare a written estimate detailing the materials,
labor, and costs needed to complete necessary construction, reconstruction, or restoration work.
If Customer selects Fire and Water to perform such construction, reconstruction, or restoration
work, Fire and Water agrees to waive any costs for preparing said estimate. In the event that
Customer does not select Fire and Water to perform such construction, reconstruction, or
restoration work, Customer agrees to compensate Fire and Water for all reasonable time spent on
inspecting the property and preparing the estimate, at a rate of $150 per hour. Such payment is
due within 30 days of Fire and Water's delivery of the estimate and invoice to Customer.
Time Required, Costs, Payment and Cancellation
Due to the nature of emergency cleaning and/or restoration work performed under this
Agreement, and given that Fire and Water cannot predict the full extent of any damage, the total
time and cost of cleaning and/or remediation work cannot be determined at the outset. In the rare
event that this cost can be determined at the outset, Fire and Water will inform the Customer of
the cost before commencing work. Upon substantial or full completion of the work herein
described, Fire and Water shall provide Customer and any involved insurance company with an
invoice totaling the amount due, which shall become part of this agreement.
If insured. Customer hereby authorizes and instructs that direct payment be made to Fire and
Water. Customer is personally responsible for and shall pay Fire and Water any deductible
amount. Customer agrees to make full payment of the invoice amount to Fire and Water within.
30 days of the date of the invoice, regardless of insurance coverage. If full payment is not made
within 30 days, Customer will be deemed to be in default of its payment obligations.
Default for Nonpayment
If Customer is in default of its payment obligations under this agreement and Fire and Water
commences a court proceeding to collect amounts due hereunder, Customer shall be liable for
Fire and Water's court costs, reasonable attorneys' fees and all other costs of collection.
Customer consents to the jurisdiction of the courts of Middlesex County, Massachusetts, with
respect to any action or proceeding arising under or relating to this agreement. Such jurisdiction
is non-exclusive and suit may brought in a different court having jurisdiction over the parties.
This agreement shall be interpreted in accordance with Massachusetts law.
Execution of Contract
The contract should not be signed until a copy of all exhibits and referenced documents have
been attached. One original signed copy of the contract is to be given to Customer and the other
kept by Fire and Water. Any modification to the original contract must be in writing and agreed
to by both parties.
I HAVE READ, UNDERSTAND, AND AGREE TO THE ABOVE TERMS AND I
AUTHORIZE BCM TO PERFORM THE SERVICES DESCRIBED ABOVE. I AM THE
OWNER OF THE PROPERTY OR AM AUTHORIZED TO ENTER THIS AGREEMENT ON
BEHALF OF THE OWNER OF THE PROPERTY. I UNDERSTAND THAT THE
PROPERTY OWNER IS PERSONALLY RESPONSIBLE FOR ANY AND ALL CHARGES,
COSTS, AND DEDUCTIBLES NOT COVERED BY INSURANCE.
